3. DUE TO THE CONFIDENTIAL NATURE OF COPYRIGHTED MATERIAL AND SYSTEMS PROVIDED IN PRODUCT, BUYER MUST AGREE TO SIGN A NON-COMPETE AGREEMENT AS TO PREVENT ANY FUTURE USE OF COPYRIGHTED MATERIALS AND SYSTEM.
4. BUYER AGREES THAT IF A WEBSITE HAS BEEN CREATED AND OR HOSTED FOR BUYER THAT BUYER AGREES TO PAY A FEE OF $495 FOR SUCH SITE. FEE WILL BE IMMEDIATELY DEBITED FROM ANY REFUND.

DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING SERVICES OR WRITTEN MATERIALS IN THE TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS OR OTHERWISE THE ENTIRE RISK, AS TO THE RESULTS AND PERFORMANCE OF THE WEB SITES PRODUCTS, SEVICES OR WRITTEN MATERIALS ARE DEFECTIVE, YOU, AND NOT WWW.DEBTNEGOTIATIONBUSINESS.COM OR NATIONAL DEBT CONSULTANTS, INC. ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING REPAIR OR CORRECTION.

PRODUCTS, INCLUDING SOFTWARE, ARE SOLD WITHOUT WARRANTY, EITHER EXPRESSED OR IMPLIED, INCLUDING WARRANTY AS TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOFTWARE & AUDIO C.D.S.WILL BE REPLACED IF NOT OPERATIVE OR DEFECTIVE.

2. REFUND POLICY

The product, service or membership referenced herein is sold with a 90 Day Conditional Money Back Guarantee.

3. CREDIT CARD CHARGES AND CREDIT CARD FRAUD PENALTIES

Buyer warrants that he or she is over 18 years of age, not subject to the Child Online Privacy Act, of legal age to enter into contractual agreements in the state in which he or she is present when he/she makes this purchase, and is the true and authorized owner of the credit card used to make this purchase. Any buyer who violates any of these requirements may be liable for civil or criminal prosecution and agrees to pay liquidated damages of any amount the equivalent of US $10,000 per fraudulent transaction, plus actual damages, and agrees that all information collected by this website may be used for prosecution and may be turned over to law enforcement agencies or to credit card companies and merchant service providers.

If the true and/or authorized owner of the credit card attempts to commit fraud upon the Seller, he/she authorizes each and every credit card company and merchant service provider to disclose to the Seller all information that could be construed as proof of credit card fraud. Any buyer who attempts to perpetrate a fraud upon Seller involving the use of a credit card herewith gives authorization for the Seller to access all credit information about the Buyer from credit reporting agencies and also authorizes the Seller to discover all relevant information from any source about the fraudulent practices of the Buyer and to reveal such information to credit reporting agencies, credit card companies, merchant service providers, collection agencies, and law enforcement agencies.

Buyer agrees that if he/she causes a fraudulent dispute claim that results in a chargeback against the Seller’s account, that the Seller is authorized to re-charge the Buyer’s credit card that was used for the original purchase to the extent that will make the Seller whole. Buyer agrees to, in addition to actual damages, pay to the Seller liquidated damages of an amount equivalent to US $10,000 for every separate fraudulent action Buyer commits.

4. CONSENT TO JURISDICTION AND FORUM SELECTION

The Purchaser agrees that all actions or proceedings arising in connection with the purchase of products from www.DebtNegotiationBusiness.com and National Debt Consultants, Inc. shall be tried and litigated exclusively in the State courts located in the County of Hennepin, State of Minnesota. The aforementioned choice of venue is mandatory in nature, thereby precluding the possibility of litigation between the parties with respect to or arising out of the purchase of products from www.DebtNegotiationBusiness.com or National Debt Consultants, Inc. in any jurisdiction other than that specified in the paragraph. Purchaser hereby waives any right they may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph and stipulates that the State Courts located in the Court of Hennepin, State of Minnesota, shall have in personam jurisdiction and venue over the Purchaser for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to purchase of any product from www.DebtNegotiationBusiness.com or National Debt Consultants, Inc. The Purchaser authorizes and accepts service of process sufficient for personal jurisdiction in any action against Purchaser as contemplated by this paragraph by certified mail.
